These Terms are the contract between you (an adult account holder) and us. They explain who may use the app, your rights to use it, what’s not allowed, disclaimers/limits, and how to contact us. By creating an account or using Ziggy (the “App”), you agree to these Terms.
We designed these Terms to be clear and readable. If anything is unclear, contact us at ziggy@kobuapps.com.
1) Who may use the App
Adults only (18+) may create an account and manage a household.
Adults may create child profiles for supervised use. Children do not provide an email address to sign in.
You are responsible for all activity in your household account.
2) Your account & security
Keep your credentials confidential. You’re responsible for activities under your account. Tell us right away if you suspect unauthorized access. You agree that the information you provide is accurate and kept up to date.
3) License and ownership
We grant you a limited, revocable, non‑exclusive, non‑transferable license to install and use the App for personal, non‑commercial household use.
The App and all related content (including designs, artwork, characters, features, documentation) are owned by Kobu LLC or our licensors and are protected by law.
Except for this limited license, no rights are granted.
4) Feedback
If you send us ideas, suggestions, or feedback, you agree we may use them without restriction or compensation. You do not obtain any ownership rights in the App or its features as a result of providing feedback.
5) Beta/Pre‑release features
Some features may be labeled beta, pre‑release, or similar. They are provided as‑is, may change at any time, and may be available only to selected users or for limited periods.
6) Points, rewards & conversions
In‑app points, streaks, badges, or other virtual items have no cash value, are not property, and are not transferable. We may modify or discontinue these features at any time. Redemption mechanics and availability may vary by plan and region.
7) Acceptable use
You agree not to: (a) misuse the App; (b) attempt to access others’ data; (c) reverse engineer, decompile, or circumvent security; (d) upload malicious code; (e) use the App for unlawful purposes; or (f) infringe intellectual property or privacy rights. We may suspend or terminate access for violations.
8) Third‑party services
The App may rely on or link to third‑party services (e.g., Supabase, Amplitude, Expo). Their terms and privacy policies apply to those services. We are not responsible for third‑party services we do not control.
9) Communications & notices
We may send you operational emails, push notifications, or low‑volume WhatsApp announcements if you opt in. You can manage preferences in the App, device settings, or by contacting us. For WhatsApp, you may leave the community at any time or reply STOP to opt out of further messages.
10) Privacy
Our Privacy Policy explains how we collect and use personal information. By using the App, you acknowledge our privacy practices. For child profiles, the adult account holder provides the necessary consents.
11) Termination
You may stop using the App at any time. We may suspend or end access if you violate these Terms, misuse the App, or if we discontinue the service. Upon termination, your right to use the App ends.
12) Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not guarantee that the App will be error‑free, secure, or available at all times.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE AMOUNTS YOU PAID (IF ANY) TO KOBU FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR, TO THE EXTENT NOT PERMITTED BY LAW, FOR PERSONAL INJURY OR DEATH CAUSED BY NEGLIGENCE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; IN THAT CASE, THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14) Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kobu and our affiliates, officers, and employees from claims arising out of your unlawful use of the App or violation of these Terms.
15) Changes to the App or Terms
We may update the App and these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., in‑App notice or email). Continued use after the effective date means you accept the updated Terms.
16) Export & compliance
You agree to comply with U.S. and other applicable export laws and sanctions. You may not use the App if you are located in a restricted territory or are a prohibited person under applicable sanctions laws.
17) App Store terms
If you download the App from the Apple App Store or Google Play, their terms may also apply. Apple’s and Google’s entities are not responsible for support or claims except as required by their terms.
18) Governing law; venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict‑of‑laws rules. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware, USA. The English version of these Terms controls.
